Please read these Terms and Conditions carefully before engaging JME Performance for any vehicle tuning services. By proceeding with our services, you acknowledge that you have read, understood, and agree to be bound by these terms.

1. Definitions

  • JME Performance / We / Us / Our: Refers to JME Performance, a vehicle tuning and modification specialist.
  • Client / Customer / You / Your: Refers to the individual or entity engaging JME Performance for services.
  • Vehicle: Refers to the motor vehicle owned by the Client, which is being presented for tuning or modification by JME Performance.
  • Services: Refers to all tuning, remapping, modification, diagnostic, and related services provided by JME Performance.
  • Software / Tune / Map: Refers to the modified engine control unit (ECU) software applied to the Vehicle by JME Performance.

2. Scope of Services

JME Performance offers a range of vehicle tuning and modification services, including but not limited to:

  • ECU remapping/tuning (Stage 1, Stage 2, Stage 3, and bespoke tunes)
  • Performance upgrades (e.g., intake, exhaust, turbo upgrades)
  • Diagnostic services
  • Maintenance and repair services related to performance modifications.

3. Vehicle Suitability and Condition

3.1. Client’s Responsibility: It is solely the Client’s responsibility to ensure that the Vehicle is in a mechanically sound and roadworthy condition prior to any Services being carried out. This includes, but is not limited to, ensuring the engine, transmission, clutch, brakes, turbocharger, fuel system, and cooling system are in good working order and capable of handling increased power and stress.

3.2. Pre-Service Inspection: JME Performance may conduct a basic visual inspection and/or diagnostic scan of the Vehicle before commencing any Services. This inspection is for our assessment only and does not guarantee the absence of underlying mechanical or electrical faults, nor does it guarantee the future reliability of the Vehicle. Any faults identified will be communicated to the Client, and JME Performance reserves the right to refuse to carry out Services if the Vehicle is deemed unsuitable or unsafe.

3.3. Existing Modifications: The Client must disclose any and all existing modifications, repairs (including non-OEM parts), or previous tuning work carried out on the Vehicle before Services commence. Failure to disclose such information may invalidate any warranties (where applicable) and JME Performance will not be held liable for any issues arising as a result.

3.4. High Mileage Vehicles: Tuning high mileage vehicles carries an increased risk of component failure. If JME Performance advises against tuning a high mileage or otherwise compromised vehicle, and the Client chooses to proceed, they do so at their own risk, and JME Performance accepts no liability for any subsequent damage.

4. Performance Gains and Risks

4.1. Approximate Figures: All stated power, torque, and fuel efficiency gains are approximate and may vary between vehicles due to factors such as vehicle condition, mileage, maintenance, ambient temperature, fuel quality, and driving style. JME Performance does not guarantee specific performance figures.

4.2. Increased Wear and Tear: Increasing engine power and performance beyond manufacturer specifications will inherently place additional stress and wear on vehicle components (e.g., engine, turbocharger, clutch, gearbox, drivetrain, braking system). This may lead to accelerated wear, reduced lifespan of components, or component failure. The Client accepts these inherent risks by engaging JME Performance for tuning services.

4.3. Latent Defects: Services may expose or exacerbate pre-existing, latent, or unknown faults or weaknesses within the Vehicle’s components. JME Performance will not be held liable for any damage or failure that occurs as a result of such pre-existing conditions.

5. Legal and Insurance Implications

5.1. Road Legal Use: a. Emissions Systems: Certain modifications, such as the removal or deactivation of Diesel Particulate Filters (DPF), Exhaust Gas Recirculation (EGR) systems, AdBlue systems, or catalytic converters, are intended strictly for off-road/motorsport use only. It is illegal to use a vehicle with such modifications on public roads in the UK, as it will no longer meet emission standards and will fail an MOT test. b. Client’s Responsibility: By requesting such modifications, the Client acknowledges and accepts that the Vehicle will become illegal for road use and assumes full responsibility for its legal use. JME Performance will not be held liable for any fines, penalties, legal action, or other consequences arising from the Client’s use of a modified vehicle on public roads. We advise such vehicles be transported to and from our premises on a recovery truck or trailer.

5.2. Insurance Notification: It is the Client’s sole responsibility to inform their insurance provider of any and all modifications carried out by JME Performance to their Vehicle. Failure to do so may result in the invalidation of your insurance policy, potential prosecution, and significant financial loss in the event of an accident or claim.

5.3. Manufacturer Warranty: Services provided by JME Performance, particularly ECU remapping, may invalidate the Vehicle’s manufacturer’s warranty. JME Performance accepts no liability for any loss of manufacturer warranty or any subsequent claims rejected by the manufacturer.

6. Payment Terms

6.1. Pricing: All prices quoted for Services are valid for 14 days from the date of quotation. JME Performance reserves the right to adjust prices without prior notice.

6.2. Deposits: A non-refundable deposit of [Amount/Percentage, e.g., £50 or 25%] may be required at the time of booking to secure your appointment and/or order parts. This deposit will be deducted from the total cost of the Services.

6.3. Full Payment: Full payment for all Services rendered is due upon completion of the work and prior to the Vehicle being released from JME Performance’s premises. We do not offer credit facilities.

6.4. Payment Methods: We accept payment via [e.g., Bank Transfer, Credit/Debit Card, Cash]. Surcharges may apply for certain payment methods.

6.5. Late Payment: Invoices not settled within 14 days of completion of work may be subject to a daily late payment charge of [Percentage, e.g., 5%] or statutory interest, whichever is higher, and/or collection agency fees. The Vehicle will not be released until full payment, including any accrued charges, is received.

7. Refunds and Warranty (Tuning Software)

7.1. No Refunds on Services Rendered: Due to the nature of the Services, once tuning software has been installed on a Vehicle and the Service completed, no refunds will be given for the tuning service itself, unless specific conditions are met as outlined below.

7.2. 14-Day Satisfaction Guarantee (where offered): In some cases, JME Performance may offer a 14-day satisfaction guarantee on certain ECU remapping services. If, within 14 calendar days of the tuning work being completed, you are genuinely unsatisfied with the performance of the tune, you must notify JME Performance in writing. You must then return the Vehicle to our premises at your own expense. Upon verification of the issue by JME Performance, we will revert your Vehicle to its original stock file and provide a refund for the tuning portion of the service, less any labour charges for the initial tune installation and subsequent reversion, and a £[Amount, e.g., 50] administration fee. This guarantee does not apply to vehicles found to have underlying mechanical faults.

7.3. Software Faults: In the rare event of a software fault directly attributable to the remap installed by JME Performance, and which is apparent immediately or soon after the Service, the Client must notify JME Performance immediately. We will endeavour to rectify the fault at no additional cost within a reasonable timeframe. If we are unable to resolve the software fault, a refund for the tuning service may be considered at our discretion. This does not cover issues arising from pre-existing mechanical faults or issues caused by third-party interference.

7.4. Exclusions from Refund/Warranty: No refunds or warranty claims will be honoured if: a. The Vehicle has been tampered with or modified by a third party after JME Performance’s Services. b. The Vehicle develops a mechanical or electrical fault not directly caused by the tuning software installed by JME Performance. c. The Client has provided inaccurate or incomplete information regarding the Vehicle’s history or condition. d. The Client fails to adhere to recommended maintenance schedules or uses incorrect fuel. e. The Client has abused the Vehicle or used it for competitive motorsport without appropriate modifications and maintenance.

8. Parts and Materials

8.1. Client-Supplied Parts: If the Client supplies their own parts for installation, JME Performance will not be liable for any faults with those parts, their suitability, or any additional labour incurred due to incorrect, ill-fitting, or poor-quality components.

8.2. JME Performance Supplied Parts: Any parts supplied and installed by JME Performance are subject to the manufacturer’s warranty. JME Performance will not be liable for any issues arising from normal wear and tear or improper use.

9. Limitation of Liability

9.1. No Liability for Consequential Loss: To the fullest extent permitted by law, JME Performance shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of earnings, loss of profit, loss of business, or legal claims, arising from or in connection with our Services.

9.2. Maximum Liability: JME Performance’s total liability to the Client for any claim arising out of or in connection with these Terms and Conditions or the Services provided shall not exceed the total charges paid by the Client for the specific Services giving rise to the claim.

9.3. Storage of Vehicles: Vehicles left on JME Performance’s premises overnight or for extended periods are done so at the Client’s own risk. While we take reasonable precautions, JME Performance will not be responsible for any loss, theft, or damage to the Vehicle or its contents whilst unattended.

10. Booking and Cancellations

10.1. Booking Confirmation: A booking is confirmed once JME Performance receives the required deposit (if applicable) and/or a verbal/written agreement has been made.

10.2. Cancellations/Rescheduling: a. If the Client wishes to cancel or reschedule a booking, they must provide JME Performance with at least [e.g., 48 hours] notice. b. Cancellations or rescheduling with less than [e.g., 48 hours] notice may result in the forfeiture of the booking deposit. c. Failure to attend a confirmed appointment without any notice will result in the forfeiture of the booking deposit and may incur additional charges.

10.3. JME Performance’s Right to Cancel/Reschedule: JME Performance reserves the right to cancel, postpone, or rebook any appointment for any reason, including but not limited to unforeseen circumstances, illness, adverse weather conditions, or vehicle suitability issues. In such cases, any deposit paid will be carried over to a rescheduled appointment or refunded if a mutually agreeable date cannot be found.

11. Data Protection

JME Performance will collect and process personal data in accordance with applicable data protection laws (e.g., GDPR). This data will be used solely for the purpose of providing Services, processing payments, and internal record-keeping. We will not share your information with third parties for marketing purposes without your explicit consent.

12. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of England, United Kingdom. Any disputes arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the Scottish courts.

13. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

14. Amendments

JME Performance reserves the right to update or amend these Terms and Conditions at any time. The most current version will always be available on our website or upon request. It is the Client’s responsibility to review these terms periodically.
